XR, LLC d/b/a BoyZShop ("BoyZShop," "we," "us," or "our") reserves the right to update or modify these Terms at any time without prior notice. Your continued use of the Website after changes constitutes acceptance of the revised Terms.

Use of this Website is limited to individuals 18 years of age or older. By accessing the Website or placing an order, you represent that you are at least 18 and have the legal capacity to enter into a binding agreement. We may refuse service, terminate accounts, or cancel orders if we believe the eligibility requirements are not met. Boyzshop.com makes no warranty, express or implied, as to the safety of any of our products. All products are sold as novelties only. We accept no responsibility for injuries sustained while using our products. The purchaser assumes all risk and liability of use. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant that the Website will be uninterrupted, error free, or free of harmful components.

4. Limitation of liability

To the fullest extent permitted by law, BoyZShop and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Website, any products purchased, or any third party conduct. Our total liability for any claim shall not exceed the greater of the amount you paid in the 12 months preceding the claim, or one hundred dollars ($100.00 USD). Some jurisdictions, including certain Canadian provinces, do not allow these limitations, in which case our liability is limited to the maximum extent permitted by law.

5. Local community standards

The content of this site falls easily within the bounds of what is acceptable in the district of Orange County. In the past 10 years there has been no prosecution of an internet site based on obscenity, and we believe the content of this site falls within the local community standard for online space.

6. 18 U.S.C. 2257 record-keeping compliance statement

All models, actors, actresses, and other persons who appear in any visual depiction of actual sexually explicit conduct on this Website were over 18 years of age at the time the depictions were created. All other visual depictions are exempt from 18 U.S.C. section 2257 and 28 C.F.R. 75 because they do not consist of conduct listed in 18 U.S.C. section 2256(2)(A) through (D), are depictions of non sexually explicit nudity or simulated conduct, or were created prior to July 3, 1995. Prices are subject to change without notice and are shown in US dollars unless stated otherwise. For orders shipped to Canada, applicable duties, taxes, and customs fees are the customer's responsibility. By submitting an order, you represent that you are authorized to use the payment method provided.

9. Shipping and delivery

We ship to every country in the world. Estimated delivery times are provided for convenience only and are not guaranteed. BoyZShop is not responsible for delays caused by carriers, customs, weather, or other circumstances outside our control. 10. Returns and refunds

Due to the nature of our products, all sales are final unless otherwise stated in our Return Policy. Please review our Returns & Exchanges policy before completing any purchase. If you receive a product that is defective or materially different from what was ordered, contact us within a reasonable time so we may evaluate the issue and offer an appropriate remedy. We reserve the right to refuse returns or refunds that do not comply with our Return Policy. EU consumers should also see our EU Right of Withdrawal.

Any dispute that cannot be resolved informally shall be submitted to binding arbitration in Orange County, California, under the rules of the American Arbitration Association, except that either party may seek injunctive relief to prevent infringement of intellectual property rights. For customers in Canada, nothing in this clause limits rights under applicable provincial consumer protection legislation that cannot be waived by contract. Dispute resolution proceedings are conducted on an individual basis, not as a class or representative action.

17. Severability and entire agreement

If any provision of these Terms is found unlawful, void, or unenforceable, it is severable and does not affect the remaining provisions. These Terms, together with our Privacy Policy, SMS Terms of Service, Return Policy, and other legal notices published on the Website, constitute the entire agreement between you and BoyZShop and supersede all prior understandings.
