Text Message Marketing Program Terms

1. Service Description

The BoyZShop mobile message service (the "Service") is operated by XR, LLC d/b/a BoyZShop ("BoyZShop," "we," or "us"). Your use of the Service constitutes your agreement to these SMS Terms of Service ("SMS Terms"). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these SMS Terms at any time, and your continued use of the Service following the effective date of any such changes constitutes your acceptance of those changes.

2. Consent to Receive Messages

By consenting to BoyZShop's SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of BoyZShop through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology.

Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with BoyZShop. Your participation in this program is completely voluntary.

3. How to Enroll

You may enroll by:

  • Checking the SMS opt-in box at checkout on our website
  • Submitting your mobile number through a web form displaying the required disclosure language

U.S. Subscriber Disclosure

By providing your phone number and consenting to receive SMS marketing messages, you agree to receive recurring automated marketing text messages from BoyZShop (XR, LLC d/b/a BoyZShop) at the mobile number provided, including promotions, new arrivals, sale events, and cart reminders. Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply. Reply STOP to 27634 to unsubscribe at any time. Reply HELP to 27634 for help.

Canadian Subscriber Disclosure (CASL)

By providing your phone number and consenting to receive SMS marketing messages, you expressly agree to receive recurring commercial text messages from XR, LLC d/b/a BoyZShop, 18047 Beach Blvd #220, Huntington Beach, CA 92649. Messages may include promotions and new product announcements. Your consent is not required for any purchase and may be withdrawn at any time by replying STOP to 27634. For help: [email protected].

4. SMS Abandoned Cart Reminder Program

Required carrier disclosure: Some carriers, such as T-Mobile, require privacy policies to explicitly describe how tracking technology is used to capture, store, and send SMS cart reminders. The following section satisfies those requirements.

4.1 Program Description

If you have opted in to our SMS program and you add items to your shopping cart on boyzshop.com but do not complete your purchase, you may receive an SMS cart reminder message from us. These messages are part of our abandoned cart reminder program and are included within the scope of the promotional messages described in Section 2 above.

4.2 Tracking Technology Disclosure

To identify when a cart has been abandoned and to trigger a cart reminder message, our website uses the following tracking technologies:

  • Browser Cookies: A first-party cookie or session token is set in your browser when you visit our website and add items to your cart. This cookie tracks your cart contents and session activity.
  • Server-Side Webhooks: When a qualifying cart event occurs (items added, cart viewed, checkout initiated but not completed), a server-side webhook transmits relevant cart session data to our SMS marketing platform provider in real time.
  • Third-Party Platform Plugins: We use a third-party SMS and email marketing platform integrated with our Shopify store to process cart event data and evaluate whether an SMS cart reminder should be sent.

No cart tracking for SMS purposes will occur unless you have previously opted in to receive SMS marketing messages from us.

4.3 Cart Reminder Limitations

In accordance with T-Mobile's Code of Conduct and CTIA guidelines, the following limitations apply to our abandoned cart reminder program:

  • Cart reminder messages are limited in frequency and will not be sent repeatedly for the same cart event. We reserve the right to adjust message frequency and timing in our sole discretion, consistent with applicable carrier guidelines.
  • Cart reminder messages will be sent within a commercially reasonable time following a qualifying cart abandonment event.
  • We will not complete transactions or process payments on your behalf via SMS.
  • Any purchase must be completed by you directly on our website via the link provided.
  • Cart reminder messages will not collect payment information or accept purchase approval via keyword confirmation.

4.4 Consent Confirmation for Cart Reminders

For subscribers who may receive abandoned cart reminder messages, we may be required by U.S. wireless carriers to obtain additional confirmation of your enrollment. If applicable, after your initial opt-in you may receive a confirmation text message asking you to verify your consent. Cart reminder messages will only be sent to subscribers who have provided the required level of consent under applicable carrier guidelines.

5. Charges and Fees

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details.

6. How to Opt Out

You may opt out of the Service at any time using any of the following methods:

  • Reply STOP to 27634 or to any SMS or text message you receive from us
  • Click the unsubscribe link (where available) in any text message
  • Email us at [email protected]
  • Call us at 1-866-363-0676

Upon receipt of a valid opt-out request, you will receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you.

In accordance with FCC rules effective April 11, 2025, we will process all opt-out requests within 10 business days. Best practice is to process them in real time. After receiving an opt-out, we may send a single confirmation message within 5 minutes (containing no promotional content), but no further marketing messages will follow.

7. Data Handling and Privacy

7.1 Data We Collect

In connection with your use of the Service, we collect and maintain the following data:

  • Your mobile phone number
  • Your SMS opt-in consent record, including date, time, method of consent, and the exact disclosure language presented at enrollment
  • Your opt-out record and timestamp (if applicable)
  • Cart session data (items, timestamps, session identifiers) used solely to trigger abandoned cart reminders
  • Message delivery status logs

7.2 Data Retention

Your SMS consent record, including opt-in date, time, method, and disclosure language, will be retained for a minimum of 5 years to support compliance with the TCPA, applicable state laws, CTIA guidelines, and CASL.

Cart event data is retained for the minimum period necessary to evaluate and deliver applicable cart reminder messages, after which it is no longer used for SMS purposes.

7.3 Third-Party Data Sharing

We respect your right to privacy with respect to your SMS data. Specifically:

  • Your SMS opt-in data and consent status will not be shared with, sold to, or transferred to any third party for their independent marketing purposes.
  • Your mobile phone number is shared only with our SMS marketing platform provider strictly for the purpose of routing and delivering messages you have consented to receive.
  • Your mobile phone number is transmitted through carrier networks solely to route the message to your device. These carriers are not liable for delayed or undelivered messages.
  • We do not sell, rent, or trade your mobile number to data brokers, lead generators, or advertising networks.

Carrier Compliance Statement: In accordance with T-Mobile's Code of Conduct and CTIA Messaging Principles and Best Practices (May 2023), BoyZShop affirms that consumer opt-in data and SMS consent status will not be shared with any third party in a manner that would be impermissible or unlawful, and will not be used for purposes beyond delivering messages the consumer has expressly consented to receive.

8. Changes to Sending Numbers

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages you send to a short code or telephone number we have changed may not be received, and we will not be responsible for honoring requests made to discontinued numbers. Please re-send your request to our current active number or contact us by email or phone.

9. Your Mobile Number

You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to re-enroll in the Service with your new number. The wireless carriers supported by the Service are not liable for delayed or undelivered messages.

10. Carrier Compliance

The Service operates in compliance with the following regulatory frameworks and industry guidelines:

  • Telephone Consumer Protection Act (TCPA)
  • CTIA Messaging Principles and Best Practices (May 2023, as updated)
  • T-Mobile Code of Conduct
  • The Campaign Registry (TCR) 10DLC registration requirements (mandatory as of February 2025)
  • FCC consent revocation rules effective April 11, 2025
  • Canadian Anti-Spam Legislation (CASL) and CRTC guidelines for Canadian subscribers
  • Applicable state Mini-TCPA laws, including Florida (FTSA) and Texas (SB 140, effective September 1, 2025)

Our sending numbers are registered through The Campaign Registry (TCR) and operate on carrier-approved 10-digit long code (10DLC) or short code infrastructure.

11. Canadian Subscribers -- CASL

Our SMS program for Canadian subscribers relies exclusively on express consent. Implied consent does not apply to SMS marketing, and abandoned cart messages to Canadian subscribers require express consent before sending. Every SMS to a Canadian subscriber includes our brand name and access to our contact information at no cost to the recipient. Unsubscribe requests from Canadian subscribers are processed within 10 business days, as required by CASL. Consent applies only to messages from BoyZShop / XR, LLC d/b/a BoyZShop and is not transferable to any other brand or entity.

12. Age Requirement

Our SMS program is available only to individuals 18 years of age or older. By enrolling, you represent and warrant that you are at least 18 years of age. Subscribers found to be under 18 will be removed immediately.

13. Content and Prohibited Use

All messages identify our brand and include an opt-out reminder. We do not send marketing messages before 8:00 AM or after 8:00 PM in the recipient's local time zone. We do not include prohibited content as defined by CTIA S.H.A.F.T. guidelines in any SMS messages.

14. Limitations of Liability

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service. The wireless carriers supported by the Service are not liable for delayed or undelivered messages.

17. Governing Law

These SMS Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. For Canadian subscribers, nothing in these SMS Terms limits any rights you may have under applicable provincial consumer protection legislation that cannot be waived by contract.

18. Changes to These Terms

We may modify, suspend, or discontinue our SMS program at any time. Material changes will be posted at https://www.boyzshop.com/pages/sms-terms with a revised effective date.
