Text Message Marketing Program Terms. Last updated: March 18, 2026. Operated by XR, LLC d/b/a BoyZShop, 18047 Beach Blvd #220, Huntington Beach, CA 92649.

1. Service description

The BoyZShop mobile message service (the "Service") is operated by XR, LLC d/b/a BoyZShop ("BoyZShop," "we," or "us"). Your use of the Service constitutes your agreement to these SMS Terms of Service ("SMS Terms"). We may modify or cancel the Service or any feature without notice, and may modify these SMS Terms at any time as permitted by law. Continued use after the effective date of changes constitutes acceptance.

2. Consent to receive messages

By consenting to the Service, you agree to receive recurring SMS or text messages from and on behalf of BoyZShop through your wireless provider at the mobile number you provided, even if that number is on any state or federal Do Not Call list. Messages may be sent using an automatic telephone dialing system or other technology. Service messages may include order updates and account alerts. Promotional messages may include promotions, specials, and cart reminders. You do not have to sign up to make a purchase, and consent is not a condition of any purchase. Participation is voluntary.

3. How to enroll

You may enroll by checking the SMS opt-in box at checkout, or by submitting your mobile number through a web form displaying the required disclosure language.

US subscriber disclosure. By providing your phone number and consenting, you agree to receive recurring automated marketing text messages from BoyZShop (XR, LLC d/b/a BoyZShop) at the number provided, including promotions, new arrivals, sale events, and cart reminders. Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply. Reply STOP to 27634 to unsubscribe, or HELP to 27634 for help.

Canadian subscriber disclosure (CASL). By providing your phone number and consenting, you expressly agree to receive recurring commercial text messages from XR, LLC d/b/a BoyZShop, 18047 Beach Blvd #220, Huntington Beach, CA 92649. Messages may include promotions and new product announcements. Consent is not required for any purchase and may be withdrawn at any time by replying STOP to 27634. For help: [email protected].

4. SMS abandoned cart reminder program

Some carriers, such as T-Mobile, require privacy policies to describe how tracking technology captures, stores, and sends SMS cart reminders. If you have opted in and add items to your cart at boyzshop.com but do not complete your purchase, you may receive an SMS cart reminder. These are promotional messages within the scope of Section 2.

Tracking technology. A first-party cookie or session token is set when you add items to your cart, tracking cart contents and session activity. A server-side webhook transmits cart session data to our SMS platform provider in real time when a qualifying event occurs. We use a third-party SMS and email platform integrated with our Shopify store to evaluate whether a reminder should be sent. No cart tracking for SMS occurs unless you have opted in.

Limitations. Cart reminders are limited in frequency and will not repeat for the same cart event. They are sent within a commercially reasonable time after abandonment. We will not complete transactions or process payments via SMS, and any purchase must be completed by you on our website through the link provided. We may require additional confirmation of your enrollment, and cart reminders are sent only to subscribers who provided the required level of consent.

5. Charges and fees

We do not charge for the Service, but you are responsible for all charges and fees from your wireless provider. Message frequency varies, and message and data rates may apply. Check your mobile plan for details.

6. How to opt out

You may opt out at any time by replying STOP to 27634 or to any message you receive from us, clicking an unsubscribe link where available, emailing [email protected], or calling 1-866-363-0676. You will receive a one-time opt-out confirmation. In accordance with FCC rules effective April 11, 2025, we process opt-out requests within 10 business days, and aim to process them in real time. After an opt-out we may send a single confirmation within 5 minutes with no promotional content.

7. Data handling and privacy

We collect your mobile number, your SMS opt-in consent record (date, time, method, and the disclosure language presented), your opt-out record and timestamp, cart session data used solely to trigger reminders, and message delivery logs. Your consent record is retained for at least 5 years to support compliance with the TCPA, applicable state laws, CTIA guidelines, and CASL. Cart event data is retained only as long as needed to deliver applicable reminders.

Your SMS opt-in data and consent status will not be shared with, sold to, or transferred to any third party for their own marketing purposes. Your mobile number is shared only with our SMS platform provider to route and deliver messages you consented to receive, and transmitted through carrier networks solely to reach your device. We do not sell, rent, or trade your number to data brokers, lead generators, or advertising networks. In accordance with the T-Mobile Code of Conduct and CTIA Messaging Principles and Best Practices, BoyZShop affirms that consumer opt-in data and SMS consent status will not be shared in any impermissible manner or used beyond delivering messages you have consented to receive.

8. Changes to sending numbers

We may change any short code or telephone number used to operate the Service at any time and will notify you. Messages sent to a changed number may not be received, and we are not responsible for honoring requests made to discontinued numbers. Re-send your request to our current number or contact us by email or phone.

9. Your mobile number

You agree to provide a valid mobile number. If you get a new number, you must re-enroll with the new number. Supported wireless carriers are not liable for delayed or undelivered messages.

10. Carrier compliance

The Service operates in compliance with the TCPA; CTIA Messaging Principles and Best Practices; the T-Mobile Code of Conduct; TCR 10DLC registration requirements; FCC consent revocation rules effective April 11, 2025; CASL and CRTC guidelines for Canadian subscribers; and applicable state Mini-TCPA laws, including Florida (FTSA) and Texas (SB 140, effective September 1, 2025). Our sending numbers are registered through The Campaign Registry and operate on carrier-approved 10DLC or short code infrastructure.

11. Canadian subscribers (CASL)

Our SMS program for Canadian subscribers relies exclusively on express consent. Implied consent does not apply, and cart reminders to Canadian subscribers require express consent. Every message includes our brand name and free access to our contact information. Unsubscribe requests are processed within 10 business days. Consent applies only to messages from BoyZShop / XR, LLC d/b/a BoyZShop and is not transferable to any other brand or entity.

12. Age requirement

Our SMS program is available only to individuals 18 years of age or older. By enrolling, you represent that you are at least 18. Subscribers found to be under 18 will be removed immediately.

13. Content and prohibited use

All messages identify our brand and include an opt-out reminder. We do not send marketing messages before 8:00 AM or after 8:00 PM in the recipient's local time zone, and we do not include content prohibited by CTIA S.H.A.F.T. guidelines.

14. Limitation of liability

To the extent permitted by law, we are not liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in that information, or any action you take in reliance on it. Supported wireless carriers are not liable for delayed or undelivered messages.

17. Governing law

These SMS Terms are governed by the laws of the State of California, without regard to conflict of law provisions. For Canadian subscribers, nothing in these SMS Terms limits rights under applicable provincial consumer protection legislation that cannot be waived by contract.

18. Changes to these terms

We may modify, suspend, or discontinue our SMS program at any time. Material changes will be posted at https://www.boyzshop.com/pages/sms-terms with a revised effective date.
